Welcome to Patched Up. These terms apply when you use our website or buy from our store. Please read them carefully, because by placing an order you agree to them.
In plain language: we sell transdermal wellbeing patches, either as one-off orders or as a subscription you can cancel at any time. You have full rights under the Australian Consumer Law and nothing here takes those away. We offer a 14-day change-of-mind refund on unopened patches, on top of those rights. If you subscribe, we will tell you before every charge and you can cancel in a few clicks from your account. If you join our rewards programme, your points are a benefit we provide rather than money, and the rules for earning and using them are set out below. Our patches support general wellbeing and are not medicines.
This website is operated by Patched Up (ABN 27 811 334 303) and is hosted on Shopify.
1. Eligibility and use of the site
To place an order you must be at least 18 years of age, or have the permission of a parent or guardian. To start a subscription you must be at least 18.
You must not use our website or products for any unlawful or unauthorised purpose, and you must not transmit malware, viruses or any harmful code, attempt to gain unauthorised access to our systems, or scrape, copy or harvest content from the site by automated means. If you do, we may suspend or end your access immediately.
2. Your account
You may create an account to manage orders, subscriptions and rewards. You are responsible for keeping your login details secure and for activity that happens under your account. Please tell us promptly if you think someone else has accessed it.
3. Our products
Our patches are transdermal wellbeing patches. They are not medicines, and they are not intended to diagnose, treat, cure or prevent any disease.
We do our best to display product colours, ingredients and descriptions accurately, but we cannot guarantee your screen shows colours exactly as they appear in real life.
Products may be limited in quantity and availability. We may:
- limit or cancel orders at our discretion, including where a product is out of stock, incorrectly priced, or where we suspect fraud or misuse of a discount
- refuse service to anyone where we have a lawful reason to do so
- change or discontinue a product, and where a discontinued product is part of an active subscription we will contact you before your next order
If we cancel an order you have already paid for, we will refund you in full.
4. Prices and payment
All prices are in Australian dollars and include GST unless stated otherwise. Any delivery charge or other transaction based charge is shown to you before you pay, and we do not add fees at the final step that were not disclosed earlier.
Payment is processed by Shopify Payments and other payment providers, and we do not store your full card details.
Prices, product descriptions and offers may change at any time. A change in price does not affect an order we have already accepted, and price changes for subscriptions are covered in section 6.
5. Orders
You agree to give us accurate and current billing, delivery and contact details. If we need to query, change or cancel an order we will contact you using the email address or phone number you provided.
An order is accepted when we send you a confirmation email. We do not accept bulk orders for resale without our prior written permission.
6. Subscriptions
What a subscription is. A subscription is an ongoing arrangement where we send you the products you have chosen at the interval you have chosen, and charge your saved payment method automatically each time, until you cancel. There is no minimum term, no lock in period and no exit fee.
What you are told before you subscribe. Before you confirm a subscription, the checkout shows you the products included, the amount of the first charge, the amount and frequency of later charges, the date of your first renewal, and the fact that the subscription renews automatically until cancelled.
Reminders. We will email you before each scheduled order, in time for you to skip, change or cancel it. If your subscription starts on a promotional or introductory price, we will also email you before that price ends and tell you what the ongoing price will be.
Changing your subscription. From your account you can skip an order, pause, change the delivery frequency, change the products, update your address, and update your payment method. Changes take effect for the next order provided you make them at least [INSERT NUMBER, for example 2] days before that order is scheduled.
Cancelling. You can cancel at any time, in a few clicks, from the subscription area of your account. You can also cancel by emailing hello@patchedup.com.au. Cancelling is designed to be as easy as signing up. We will not require you to phone us, complete a survey or work through retention offers in order to cancel.
Cancellation takes effect immediately and stops all future charges, provided you cancel at least [INSERT NUMBER, for example 2] days before your next scheduled order. If you cancel after that point, that order may already be processing, in which case it will be sent and charged as normal and the cancellation applies from the following order. If that happens, your return rights in section 9 still apply.
Price changes. We may change subscription prices. We will give you at least 30 days notice by email before a new price applies, and you can cancel or change your subscription at any time before then.
Discounts. Any subscription discount applies as described on the product page at the time you subscribe. [INSERT: whether the subscription discount applies to every order or only the first order.] If your subscription is cancelled and later restarted, the discount that applies is the one offered at the time you restart.
Failed payments. If a payment fails we will retry it and email you so you can update your payment details. If payment still cannot be taken after [INSERT NUMBER, for example 3] attempts, we will cancel the subscription and let you know.
7. Discount codes and promotions
Unless we say otherwise, a discount code may be used once per customer, cannot be combined with another code, cannot be applied to an order after it has been placed, and expires on the date stated in the offer. Codes have no cash value. We may cancel an order or reverse a discount where a code has been used in a way that was clearly not intended, or obtained without authorisation.
8. Rewards and loyalty programme
If we operate a rewards programme, the following applies.
Points are a benefit we provide to customers. They are not money, they have no cash value, they are not property, and they cannot be sold, transferred or exchanged for cash.
The rate at which you earn points, and what you can redeem them for, are set out on our rewards page. We may change those rates for future earning and redemption, and we will publish the change before it takes effect.
We may award points for orders you placed before joining the programme, at our discretion and to the extent our systems allow.
If an order is refunded or cancelled, any points earned on it are removed, and any points you redeemed on it are returned to your balance.
Points may expire after [INSERT NUMBER, for example 12] months of account inactivity. We will email you before your points are due to expire.
We may reverse or cancel points that were awarded in error, or obtained through misuse of the programme.
We may change or end the programme with at least 30 days notice, and we will give you a reasonable opportunity to redeem your remaining points before it ends. Points are forfeited if you close your account.
9. Delivery, returns and refunds
Delivery times and costs are set out in our Shipping and Returns policy at https://patchedup.com.au/pages/shipping-and-returns. Risk in the products passes to you on delivery.
Change of mind. We offer a no questions asked refund on unopened, unused patches returned within 14 days of delivery. Return postage is your responsibility. This is in addition to your rights below and does not limit them.
Your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure. Where a product is faulty, we cover the cost of return.
10. Health information and safe use
Information on our website is general in nature and is not medical advice. Our patches support general wellbeing and are not intended to diagnose, treat, cure or prevent any disease.
Please speak with your doctor or pharmacist before use if you are pregnant or breastfeeding, have a medical condition, or take prescription medication. Discontinue use and seek advice if you experience skin irritation or any other reaction. Check the ingredient list before use if you have known allergies or sensitivities. Keep out of reach of children.
11. Intellectual property
All content on this site, including text, photographs, graphics, logos, product names, formulations and design, is owned by or licensed to Patched Up and is protected by copyright and trade mark law. You may not copy, reproduce, republish or use it commercially without our written permission.
12. Your content and reviews
If you send us a review, photograph, idea, suggestion or other feedback, you give us a non exclusive, royalty free, worldwide licence to use, publish, edit for length and clarity, and reproduce it in connection with our business, without payment or obligation to you. You confirm the content is your own and that you have the right to give us that licence.
You must not submit content that is unlawful, misleading, abusive, defamatory, or that infringes anyone else's rights. We may remove any content at our discretion. We do not edit reviews to change their meaning and we do not remove reviews simply because they are critical.
13. Communications
We send transactional messages relating to your orders and subscriptions, including order confirmations, delivery updates, renewal reminders and payment notices. These are part of the service and are not marketing.
Marketing emails and messages are sent only with your consent, and every one includes an unsubscribe link. Unsubscribing from marketing does not cancel a subscription or stop transactional messages.
14. Privacy
We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
15. Third party services and links
We use third party services to run the store, including hosting, payment processing, subscription management, rewards, delivery and email. We may also link to third party websites. We are not responsible for the content, products or practices of third party sites, and we recommend reviewing their own terms and privacy policies.
16. Availability of the site
We aim to keep the site available and accurate, but we do not guarantee that it will be uninterrupted, error free, or free of viruses. We may suspend or withdraw the site for maintenance or other reasons.
17. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the maximum extent permitted by law:
- our liability for a failure to comply with a consumer guarantee, for goods or services not of a kind ordinarily acquired for personal, domestic or household use, is limited to replacing the goods, supplying the services again, or paying the cost of doing so
- we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, arising out of your use of the site or our products
- our total liability to you in connection with these terms is limited to the amount you paid us in the 12 months before the claim arose
18. Indemnity
You agree to indemnify Patched Up and its staff and partners against any claim arising from your breach of these terms or your breach of the law, except to the extent the claim is caused by our own negligence or breach.
19. Suspension and termination
We may suspend or close your account, and cancel any active subscriptions, if you breach these terms or use the site unlawfully. If we do, we will refund any amount you have paid for products we have not yet sent.
20. Changes to these terms
We may update these terms from time to time, and the current version is always shown on this page with its last updated date. Continued use of the site after we post a change means you accept it.
If we make a change that materially affects an active subscription, we will email subscribers at least 30 days before it takes effect, and you can cancel at any time before then.
21. General
If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, we do not give it up. You may not transfer your rights under these terms without our consent.
22. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that state.
